The petitioner is in custody in connection with Kaluahi P.S. Case No. 20 of 2019 for the offence under Sections 272, 273, 34 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that in the instant case 300 liters country made liquor was seized. Learned counsel for the Petitioner submits that from the FIR, it is evident that the petitioner is driver of the vehicle and he has no concern with the liquor in question. He submits that petitioner is in custody since 13.02.2019.

Considering the fact that the petitioner has no criminal

Let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-Cum Special Judge, Excise, Act, Madhubani in connection with Kaluahi P.S. Case No. 20 of 2019.
