The petitioner apprehends his arrest in Bihiya P.S. Case No. 135/2012, registered for the offences punishable under Section 395 of the Indian Penal Code.
It is submitted that the petitioner is not named in the FIR. The name of the petitioner figured in the case after more than a year and the investigating officer did not collect any cogent evidence against the petitioner, but from perusal of the order itself, it appears that the looted mobile having same I M E No. was used by the petitioner and this fact has come during course of investigation.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
