ANJANA MISHRA ORAL ORDER 19-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 22.02.2019 in connection with Rajauli P.S. Case No.82 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that though the alleged recoveries of 237.750 litres of liquor from sumo vehicle, petitioner is the driver of the said vehicle and was unaware of such items being available on the vehicle which he had been engaged to drive.

Considering the aforementioned facts and circumstances and petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on his furnishing

Patna High Court CR. MISC. No.25250 of 2019(2) dt.19-04-2019 2/2 bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-IIcum-Special Judge, Nawada, in connection with Rajauli P.S. Case No.82 of 2019.
