JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-09-2016 Heard learned counsel for the petitioners and the State.

Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 504, 427, 379/34 of the Indian Penal Code. The prosecution case is that the informant gave Rs. 5,06,800/- to the petitioner no. 1 namely Arun Kumar Prasad for executing a sale deed with regard to a land. On 15.3.2016 the deed was prepared, but petitioner no. 1 namely Arun Kumar Prasad did not get ready to execute the sale deed. On 02.05.2016 at 8.00 A.m. the informant went to the house of petitioner no. 1, when the accused persons including the petitioners made assault to the informant and damaged the Scorpio vehicle.

Patna High Court Cr.Misc. No.35921 of 2016 (2) dt.07-09-2016 It is submitted by the learned counsel for the petitioners that petitioner no. 1 is a deed writer and for a petty dispute accusation has been levelled.

It is submitted by the learned counsel for the informant that it appears from the impugned order that informant received injuries on the right distal radius and right 3rd rib for which he has to undergo operation at P.M.C.H. Consideration the nature of accusation, it is a case for consideration of prayer for bail on surrender within a period of six weeks before the learned Sri M.M. Alam, A.C.J.M.- III, Rosera, Samastipur in connection with Bibhutipur P.S. Case No. 128 of 2016.

With the above observation this application is disposed of.
