ANJANA MISHRA ORAL ORDER 30-01-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 29.06.2018 in connection with Kurtha P.S. Case No.56 of 2005 registered for the offence under Section 302/34 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of the Criminal Law Amendment Act.
Learned counsel for the petitioner submits that the trial which ensued with regard to the other co-accused persons has ended in acquittal and, therefore, the petitioner may be extended the privilege of bail.
However, considering the fact that the petitioner has remained at large for a considerable number of years, I am not inclined to grant regular bail to the petitioner. It is,
Patna High Court Cr.Misc. No.80246 of 2018(2) dt.30-01-2019 2/2 accordingly, rejected. The trial court is, however, directed to expedite the trial and conclude the same by the 30th of June, 2019.
