This application, for grant of anticipatory bail, arises out of Taraiya Police Station Case No. 06 of 2020, registered for the offence punishable under Section 498-A of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act. The allegation, as per the First Information Report, is that the marriage of the Opposite Party No. 2 was solemnized with the petitioner on 04.02.2015 and after the marriage, the petitioner, along with other family members, started demanding one Honda motorcycle and Rs. 2,00,000/- cash, by way of dowry and due to non-fulfillment of the said demand, the petitioner and others ousted the Opposite Party No. 2 from her matrimonial home.

Learned Counsel for the petitioner submits that both the parties, pursuant to the order of this Court, dated

Patna High Court CR. MISC. No.26378 of 2020(5) dt.12-03-2021 2/2 03.02.2021, are living together as husband and wife and both, the petitioner and his wife-Opposite Party No. 2, are present, in person, before this Court today and upon query by this Court, they have said that they are living together as husband and wife peacefully.

Having heard the submission made by the parties and taking into consideration the fact that the petitioner and his wife are living together, I am inclined to grant provisional bail, for a period of six months from today, to the petitioner. This application is, accordingly, allowed.

Let the petitioner, above named, be released on provisional bail for a period of six months from today, in the event of his arrest or surrender before the Court below within six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 5th Additional Chief Judicial Magistrate, Saran, at Chapra, in connection with Taraiya Police Station Case No. 06 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
