2. The petitioner seeks regular bail in connection with Daniyawan P.S. Case No. 228 of 2024 registered for the offence under Sections 126(2), 115(2), 103(1), 352 & 3(5) the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the petitioner is a woman. She along with others is said to have assaulted the deceased.
4. Learned counsel for the petitioner submits that the assailant of the deceased is one Suraju Bind, who is the husband of the petitioner. The petitioner is in custody since 04.11.2024 and claims a clean antecedent.
5. Learned A.P.P. for the State has vehemently
Patna High Court CR. MISC. No.25864 of 2025(2) dt.02-05-2025 2/2 opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna City, Patna/concerned Court below in connection with Daniyawan P.S. Case No. 228 of 2024, subject to condition that:- 7(i) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioner.
