JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2019 The petitioner apprehends his arrest in connection with Pirpainty P.S.Case No. 37 of 2018 registered under Sections 498A/34 of the Indian penal Code and 3 and 4 of the Dowry Prohibition Act.

Allegation against the petitioner is of subjecting his wife to cruelty and harassment with respect to demand of dowry. Submission of learned counsel for the petitioner is that earlier, prior to lodging of this case, petitioner has filed a case of kidnapping by the father of the informant for the purpose of marriage and thereafter in order to put pressure on him, present case has been lodged.

No.80769 of 2018(3) dt.06-03-2019 2/2 Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Bhagalpur in connection with Pirpainty P.S. Case No. 37 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
