The petitioner seeks bail in Kamtoul P.S. case no. 291 of 2018 instituted for the offence under Sections 379 and 414 of the Indian Penal Code and Section 37(c) of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that police apprehended three persons and after taking their breath analyzer test, it was found that they were taking alcohol. It is further alleged that one motorcycle was recovered from possession of this petitioner. On enquiry, petitioner could not produce any document of the alleged vehicle and told the police that he had purchased the motorcycle from one Robbin Yadav after giving consideration amount of Rs. 7000/- but no paper

Patna High Court Cr.Misc. No.80091 of 2018(2) dt.24-01-2019 2/2 has been given to him with respect to purchase of the said motorcycle.

Petitioner is in custody since 15.10.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, IVth cum Special Judge, Darbhanga, in connection with Kamtoul P.S. case no. 291 of 2018, G.O. case no. 931 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
