JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-08-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Kotwali P.S. Case No. 170 of 2017 for the offences punishable under section 420 of the I.P.C and sections 27 (b) ii, 28 and 28 A of the Drug & Cosmetic Act, 1940.

Allegedly, the petitioner was found running a medical shop without any license and 52 types of medicines were seized from his shop.

Submission is of false implication and that during investigation the witnesses, namely, Vishal Kumar and Ritesh

Patna High Court Cr.Misc. No.30819 of 2017 (3) dt.19-08-2017 2/2 Kumar and the seizure list witness Ganesh Kumar have stated that the petitioner was not running the medical shop rather he was keeping some medicines and he was having degree of B. Pharma and the medicines were kept for personal use and as such the petitioner deserves sympathetic consideration. The learned A.P.P. fairly submits that during investigation the independent witnesses and the seizure list witness have not supported the prosecution version. In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Gaya in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
