2. The petitioners apprehend their arrest for the offences alleged under Sections 447, 341, 323, 324, 307, 504, 506 and 34 of the Indian Penal Code registered in connection with Riga P.S. Case No. 07 of 2019. Subsequently, Section 302 of the IPC has been added.
3. It is submitted that the petitioners have been falsely implicated in the backdrop of land dispute and in any event, the thrust of accusation of assault with gransa on the head of the father of the informant is against co-accused Raushan Kumar and the petitioners are only said to have assaulted with lathi and iron rod thereafter. The petitioners claim clean antecedents.
4. Learned APP assisted by learned counsel for the informant opposes the anticipatory bail petition inviting attention to the order of the learned Sessions Judge, Sitamarhi vide order dated 12.03.2019 passed in ABP Nos. 135 of 2019 + 553 of 2019 noticing
Patna High Court CR. MISC. No.23298 of 2019(2) dt.15-04-2019 2/2 that the autopsy report discloses that the cause of death was due to haemorrhage, coma and shock due to injuries sustained by the deceased caused by the hard and blunt object.
5. Having regard to the nature of accusations and gravity of offence alleged, this Court is not inclined to grant anticipatory bail to the petitioners. The anticipatory bail petition stands dismissed.
