Koilwar P.S. Case No. 126 of 2015 is lodged on the basis of self statement of Awadhesh Prasad, S.I. of Koilwar police station. Koilwar P.S. Case No. 125 of 2015 is registered on the basis of the victim who alleged that he was being kidnapped by the accused persons and Goapljee Upadhayay opened firing but the villagers apprehended him on the spot. It appears that both the cases arose out of same occurrence.

Learned counsel for the petitioner seeks permission to withdraw this anticipatory bail petition so that the petitioner may file petition before the court, in seisin of the case, to amalgamate both the cases as both the cases arose out of same incident. Prayer is allowed.

Patna High Court Cr.Misc. No.30368 of 2016 (3) dt.27-10-2016 2/2 The anticipatory bail petition is dismissed as withdrawn.
