The petitioners, three in number, apprehend their arrest in a case under Sections 323, 498A of the Indian Penal Code and Sections 3 / 4 of the D.P. Act.

The petitioners are mother-in-law and brothers-inlaw of the complainant. It is submitted that omnibus and general allegations have been made against the petitioners although the petitioners have no manner of concern with the family affairs of the complainant as well as her husband. Gopal Prasad Sah, the husband of the complainant, has already been enlarged on bail vide order dated 09.04.2015 passed in Cr. Misc. No. 36775/2014.

No.31269 of 2014 (4) dt.29-10-2015 2/2 Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sikrahana at Motihari in Complaint Case No. C-1072 of 2010, corresponding to Tr. No. 841 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
