====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 29-10-2015 In this case, appellants have challenged the order date d 15th January 2013 whereby and whereunder the court below has refused to give relief to the appellants.

It is admitted fact that with regard to the issue involved in the present case, the petitioner had approached this Court in CWJC No. 5900 of 2010 and later on the same was challenge d in LPA No. 824 of 2010. At both the places, the present appellants lost.

In such view of the matter, it will not be justified and proper for this court to interfere with the order of the court below Accordingly, this appeal is dismissed. However, any action will be subject to result of the suit and if the appellant succeeds t he court below will pass necessary orders in accordance with law. The court below is directed to expedite the trial, subject to co-operation ext ended by the parties.
