JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-01-2019 The petitioners apprehend their arrest in connection with Barharia P.S.Case No. 255 of 2018 registered under Sections 147, 148, 149, 307, 323, 324, 341, 354B, 379, 380, 504 and 506 of the Indian penal Code.
Allegation as per the FIR is that informant went to Siwan for purchasing sand and while he was returning, three accused persons surrounded him, abused and threatened him as to why he had informed about the gambling and drinking taken by those accused persons and there is also allegation against co-accused Ezaz and Samshuddin of assaulting the informant with Tangi. Further allegation is that Samshuddin tried to outrage the modesty of his wife and snatching of her earring. It is further
Patna High Court Cr.Misc. No.1223 of 2019(2) dt.18-01-2019 2/2 alleged that they assaulted the son of the informant causing him injury.
Submission of learned counsel for the petitioners is that in spite of detail FIR, no specific allegation has been attributed against these petitioners rather specific allegation are against other accused persons and the petitioners have no criminal antecedent.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan in connection with Barharia P.S.Case No. 255 of 2018 ; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
