2. The petitioner seeks bail in connection with S.Tr. No. 936 of 2023 arising out of Kotwali (Barari) P.S. Case No. 705 of 2023 registered for the offence under Section 304(B), 120(B), 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner, who is the husband of the deceased, is alleged to have killed his wife. The petitioner is in custody since 3.8.2023.

4. It has been submitted by the learned counsel for the petitioner that in the trial, three witnesses have been examined but none of them have supported the prosecution case.

5. Considering the fact that none of the witnesses have supported the prosecution case and also considering the period of custody of the petitioner, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge-X, Bhagalpur/concerned Court below in connection with S.Tr. No. 936 of 2023 arising out of Kotwali (Barari) P.S. Case No. 705 of 2023.

7. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
