JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code. Petitioner is not named in the first information report but from perusal of the impugned order it would appear that petitioner was arrested in Hulasganj P.S. Case No. 75 of 2016 and in that case he confessed his guilt disclosing his involvement in the present case also. Similarly, the other accused of the aforesaid case also disclosed the involvement of the petitioner in the present case. Moreover, petitioner is in jail custody since 09.12.2016 and except the aforesaid material, there appears to be nothing against the petitioner.

No.80186 of 2018(2) dt.17-01-2019 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Jehanabad in connection with Ghosi P.S. Case No. 179 of 2016.
