JUSTICE SANJAY KUMAR ORAL ORDER 06-07-2017 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner apprehends his arrest in connection with Kutumba P.S. Case No. 54 of 2017 instituted for the offences punishable under Sections 25(1-b)a/26/35 of the Arms Act and Section 17 C.L.A. Act.
The informant of this case is the Police Officer, who allegedly apprehended one Tauhid Alam and on search, he seized one country made loaded firearm, few cartridges and one Samsung mobile from his possession. The said apprehended accused in his confession disclosed the name of this petitioner. The petitioner has clean antecedent except one case registered for the offence under Sections 341 and 323/34 of the
Patna High Court Cr.Misc. No.30927 of 2017 (2) dt.06-07-2017 Indian Penal Code, which according to the learned counsel for the petitioner was registered for the dispute between the cosharer. In the aforesaid facts and circumstances, the anticipatory bail prayer is allowed. The petitioner, above named, in the event of arrest / surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Kutumba P.S. Case No. 54 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
