The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.
There is recovery of 440 liters of liquor from plastic bags loaded on four different motorcycles and petitioner has been made accused in this case on the confessional statement of co-accused, who was apprehended on spot.
It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of any of the motorcycles in question. Petitioner has got clean antecedent. Considering the nature of allegation and clean
