1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Khajauli P.S. Case no.221 of 2022 registered under sections 379, 147, 149, 341, 323, 353, 354, 332, 427, 504 and 506 of the Indian Penal Code.

3. As per the prosecution case, it is stated that on secret information having been received and the informant having proceeded to enquire about illegal mining being done in the area, it is stated that persons numbering around 50 started to protest. They snatched the mobile phone of the informant, abused and pushed him. Nagendra Kumar Singh was arrested. It is further stated that from the videography done from one another mobile, some of the accused persons including this petitioner was identified amongst the miscreants.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. He has neither any concern with any mining activity nor is in any manner affected by any enquiry being done by the informant or any other person. He is in custody since 17.2.2023.

5. Heard learned A.P.P. for the State.

6. Having heard learned counsel for the parties and taking into consideration the nature of allegation in the F.I.R. against this petitioner together with the petitioner having remained in custody since 17.2.2023, the Court directs the petitioner to be enlarged on bail in connection with Khajauli P.S. Case no.221 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Madhubani.
