JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 332, 338, 379, 353, 354(A), 435, 504, 427, 120B of the Indian Penal Code and Section 27 of the Arms Act. The prosecution case, as per the written report of the Circle Officer is that he received an order from the District Magistrate, Madhubani to remove the encroachment from Vijay Ashram but the mob set ablaze a JCB machine and pelted stones causing injury to the police and administrative officials leading to registration of the F.I.R. against 26 known and 500 unknown.

It is submitted by learned counsel for the petitioner that accusation is omnibus and general against the petitioners and similarly situated co-accused have been granted anticipatory bail vide Cr. Misc. No. 40951 of 2015.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur in connection with Madhepur P.S. Case No. 28 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
