The petitioner apprehend his arrest in Harnaut P.S. Case No. 167 of 2017 registered for the offences punishable under Sections 279, 286, 287, 304, 308, 324, 326, 120B of the Indian Penal Code and Sections 3, 4 and 5 of Explosive Substance Act. The informant Circle Officer alleged that a bus got fire in which seven persons were burnt to death and 8 persons got burn injuries. It is alleged that accident took place due to negligence of the conductor, driver and owner of the bus. Learned counsel for the petitioner submits that the petitioner is the owner of the bus. The petitioner was not present in the bus at the time of occurrence. The conductor and driver of the bus were plying the bus. No material is collected against the

Patna High Court Cr.Misc. No.30743 of 2017 (3) dt.22-08-2017 petitioner to show that the he has committed any negligence. It is an unfortunate accident in which many persons died. Learned APP has not been able to show any material against the petitioner.

Considering the facts aforesaid and the fact that the petitioner is owner of the bus but he was not in his bus, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Biharsharif, Nalanda in Harnaut P.S. Case No. 167 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
