JUSTICE SUDHIR SINGH ORAL ORDER 07-05-2019 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant. The petitioners seek bail in a case instituted for the offences under Sections 341, 326A, 307, 504/34 of the Indian Penal Code.
The prosecution case in short is that the accused persons started abusing the informant and on protest made by the informant, the accused persons thrown acid on him due to which he received injury.
It has been submitted on behalf of the petitioner that the petitioners are in custody since 6.10.2018 and have got no criminal antecedent. There is no allegation of tampering of
Patna High Court CR. MISC. No.79641 of 2018(4) dt.07-05-2019 2/2 witnesses alleged against the petitioners. Charge-sheet has been submitted in the present case. The petitioners have falsely been implicated in the present case.
Learned counsel for the petitioners and learned counsel for the informant jointly submit that the matter has been compromised between the parties. The informant does not want to pursue the matter.
Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VI, Gopalganj in connection with Sidhwaliya P.S. Case No. 198 of 2018.
