2. In this case, the petitioner is seeking regular bail in connection with Birpur P.S. Case No. 99 of 2024, registered for the offences punishable under Sections 302 and 34 of the IPC and Section 27 of the Arms Act.

3. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in the present case. The petitioner has clean antecedent and he is in custody since 25.06.2024.

4. On the other hand, Mr. Chandra Sen Prasad Singh learned APP for the State has opposed the prayer for bail.

5. From perusal of the statement of the witness,

No.24412 of 2025(3) dt.06-08-2025 2/2 namely, Gulshan Kumar recorded at para-6 of the case diary, it appears that wife of the deceased was not in a condition to lodge the FIR as she was weeping and she became unconscious. It was the reason that FIR was lodged on the next day of the occurrence in which, she has stated that the petitioner fired at temporal region of the deceased.

6. Considering the above-mentioned facts and circumstances, the petitioner does not deserve the privilege of bail. Accordingly, it is rejected.
