Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offences punishable under Section 147/148/149 /341 /302 /504 / 506 of the Indian Penal Code.
The petitioner allegedly caused multiple dagger blow to the deceased. The petitioner is in custody since 04.07.2018. Earlier prayer for bail was refused on 10.06.2019 vide order at Annexure-1.
On renewal of this prayer a report was called for from the trial Judge and the report revealed that the trial was at the
Patna High Court CR. MISC. No.21735 of 2020(3) dt.02-11-2020 2/2 verge of conclusion. Hence, vide order dated 22.07.2020 again a report was called for and the report dated 13.08.2020 would show that the trial has not concluded as yet. Considering the period already undergone by the petitioner and undertaking of the petitioner to fully cooperate with the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sessions Trial No.539 of 2018, arising out of Andar P.S. Case No.116 of 2018, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
