1. Learned counsel for the petitioners seeks permission to withdraw the present Cr. Misc. Application with regard to petitioner no.1, namely, Raju Kumar @ Raju Ranjan Kumar.

2. Permission, as prayed for, is granted.

3. Accordingly, the present Cr. Misc. Application stands dismissed as withdrawn with regard to petitioner no.1, namely, Raju Kumar @ Raju Ranjan Kumar.

4. Heard learned counsel for the petitioners, learned A.P.P. for the State and learned senior counsel for the informant.

5. The petitioner nos.2 & 3 apprehend their arrest in connection with Bibhutipur P.S. Case No.54 of 2026 instituted

Patna High Court CR. MISC. No.23289 of 2026(3) dt.11-05-2026 2/3 under Sections 126(2), 115(2), 118(1), 190(1), 117(2), 74, 303(2), 352, 351(2), 3(5) of the B.N.S., 2023.

6. As per the prosecution case, the informant has alleged that when he was at his house then all the accused persons including the petitioners came at his house having armed with weapons and started assaulting the informant causing injury to him. It is alleged that accused Raju Kumar (petitioner no.1) assaulted by iron rod on the head of informant causing eight stitches to the injuries on his head. It is alleged that when the brother and wife of informant came to rescue him, they were also assaulted by the accused persons. It is also alleged that the accused persons forcibly snatched a gold pendant from the neck of informant.

7. Learned counsel for the petitioner nos.2 & 3 submits that petitioners are innocent and have been falsely implicated in this case due to village politics and previous enmity between the parties. He further submits that both the parties are neighbours and co-villagers and due to petty dispute, a free fight takes place between the parties in which both the parties got injured. Learned counsel submits that there is case and counter case between the parties for the same occurrence. He further submits that injuries allegedly caused by these

Patna High Court CR. MISC. No.23289 of 2026(3) dt.11-05-2026 3/3 petitioners are simple in nature. Learned counsel submits that petitioners have got clean antecedent and they undertake to cooperate in the investigation and trial of the case.

8. Learned A.P.P. for the State and learned senior counsel for the informant have opposed the prayer for anticipatory bail.

9. Considering the facts and circumstances of the case, submissions of learned counsel for the parties and the nature of allegation leveled against the petitioners as well as their clean antecedent, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner nos.2 & 3 be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount to each to the satisfaction of the learned S.D.J.M., Rosera/ concerned Court in connection with Bibhutipuri P.S. Case No.54 of 2026, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
