The petitioners apprehend their arrest in Baniyapur P.S. Case No. 86 of 2016, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant alleged that Vikash Kumar Ram, petitioner no. 1 and Dasai Ram, father of the informant were quarrelling but the villagers pacified them. After some time Vikash Kumar Ram after taking wine came and abused the informant. It is alleged that the petitioners assaulted the informant and his family members.

It is submitted that there is a case and counter case being Baniyapur P.S. Case No. 85 of 2016 which was registered

Patna High Court Cr.Misc. No.30347 of 2016 (2) dt.14-09-2016 2/2 on behalf of the petitioners. The informant Prabhu Ram got two injuries which are simple in nature.

Considering the facts aforesaid and the fact that there is case and counter case and both sides sustained injuries which are simple in nature, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran in connection with Baniyapur P.S. Case No. 86 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
