1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Imamganj P.S. Case no.263 of 2023 registered under sections 354B, 379, 414 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that the auto driver and one another person who happens to be the petitioner herein, on the informant renting the auto, misbehaved with her on her way back.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. No such occurrence as alleged in the FIR has taken place. The petitioner is in custody since 15.10.2023. His case stands on a similar footing with co-accused Pradhim Kumar who has been enlarged

Patna High Court CR. MISC. No.26733 of 2024(3) dt.10-05-2024 2/2 on bail vide order dated 12.3.2024 passed in Cr. Misc. no.13544 of 2024. Charge-sheet has been submitted in the case.

5. The application for bail is opposed by learned A.P.P for the State.

6. Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the FIR, his having remained in custody for 7 months since 15.10.2023, investigation in the case having concluded and grant of bail to co-accused vide order dated 12.3.2024 passed in Cr. Misc. no. 13544 of 2024, the petitioner is directed to be enlarged on bail in connection with Imamganj P.S. Case no.263 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gaya.
