JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05/ 16.11.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner happens to be mother-in-law of the deceased and apprehends her arrest in connection with a case registered under section 304B/34 of the Indian Penal Code. Submission on behalf of the petitioner is that husband of the deceased faced trial in Sessions Trial no. 182/2016 before Addl. Sessions Judge I, Patnacity and after full-fledged trial, husband of the deceased was acquitted vide judgment dated 28.4.2016. It is further pointed out that in course of trial of husband of the deceased, informant admitted that neither there was any illegal demand nor deceased was ever put in cruelty. It is also submitted on behalf of the petitioner that fate of the trial of the petitioner is well known and it is worthless to remand the petitioner in jail custody.

Patna High Court Cr.Misc. No.28087 of 2016 (5) dt.16-11-2016 Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri P.K.Ratan, Judicial Magistrate, Ist Class, Patnacity/ concerned court in Fatuha P.S. Case no. 259/2015 subject to condition as laid down under section 438(2) of the Cr.P.C.
