This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Rosera PS Case No. 223 of 2017 for the alleged offence under Section 304/34 of the Indian Penal Code. Allegation against the petitioner is medical negligence. Learned counsel appearing for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel further submits that after the treatment of the deceased at nursing home of the petitioner the deceased was taken to different hospitals where twice the deceased was operated upon for throat disease and other ailment not connected with
Patna High Court Cr.Misc. No.80628 of 2018(2) dt.16-01-2019 2/2 appendix. Petitioner is in custody since 25.10.2017. Considering the totality of fact situation, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate -1, Rosera, District Samastipur in connection with Rosera PS Case No. 223 of 2017.
