The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 302, 120(B), 34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, all the FIR named accused persons including petitioner resorted to indiscriminate firing as a result of which the wife of informant died. Five other persons sustained gunshot injuries.

It is submitted that specific accusation of firing is against co-accused Rajiv Yadav and Chandrashekhar Yadav. There is general and omnibus allegation of indiscriminate firing against others. Petitioner is cousin brother of Neelam Kumari in whose marriage ceremony he came to participate and he has got

Counsel for State however vehemently opposed the prayer for bail and submitted that petitioner is named in the FIR and there is specific allegation that petitioner along with others made indiscriminate firing in which wife of informant died and five other persons sustained gunshot injuries. Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail in connection with Narpatganj P.S. Case No. 278 of 2022.
