2. The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial No. 65 of 2023, arising out of Saharsa Sadar P.S. Case No. 864 of 2022 dated 21.10.2022, registered for the offences punishable u/ss 302, 120B of the Indian Penal Code.

3. As per the prosecution case, the petitioner and other co-accused persons are alleged to have killed the father of the informant with sharp edged weapon and left his body in the shop and blanket was smeared with blood.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has no criminal antecedent as stated in

Patna High Court CR. MISC. No.29998 of 2024(2) dt.30-04-2024 2/2 para 3 of the bail petition. There was land dispute between both the parties for passage. The specific allegation is on co-accused Shambhu Pandit of threatening the informant. The petitioner is not named in F.I.R. and there is no cogent material found against the petitioner. The name of the petitioner surfaced in this case on the basis of suspicion. The petitioner is in custody since 07.11.2022.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Saharsa in connection with Sessions Trial No. 65 of 2023, arising out of Saharsa Sadar P.S. Case No. 864 of 2022.

7. The application stands allowed.
