This appeal has been filed for grant of pre-arrest bail in connection with Lalganj P.S.Case No. 251 of 2016 registered for the offences punishable under Sections 341, 323, 379, 504/34 of the Indian Penal Code and 3(i)(x) of the SC/ST Act and for setting aside the order dated 27.1.2017 passed by Additional District and Sessions Judge-VI, Vaishali at Hajipur.
Allegation against the appellant is of abusing and assaulting the informant.
Submission of learned counsel for the appellant is that there is land dispute between the parties from before and further the appellant is aged 87 years.
Patna High Court CR. APP (SJ) No.1881 of 2017 (4) dt.04-09-2017 2/2 Learned Special P.P. has opposed the prayer for prearrest bail of the appellant on the ground of maintainability of the appeal.
Having heard both sides and in view of allegation, the appeal is not maintainable.
Let appellant surrender and pray for regular bail, which will be considered by learned Special Judge on the basis of submission made above and materials available on record and disposed of the same preferably on the same day, without being prejudiced by this order.
The appeal is, accordingly, disposed of.
