Patna High Court CWJC No.9397 of 2020(3) dt.28-06-2021 2/3 counsel appearing on behalf of the respondents. The grievance of the petitioners in the present writ application is that the land is commercial in nature and it was acquired for construction of Toll Plaza. Instead of awarding compensation as commercial land, the respondents have not paid compensation of Do Fasla land, such action of the respondents is arbitrary.
Learned senior counsel for the petitioners further submits that till date the petitioners have not received any compensation.
In the event the petitioners have not received any compensation, the respondents are required to pay the amount of compensation as determined by them as early as possible preferably within a period of six weeks. In the event, the petitioners are aggrieved by quantum of compensation and categorization of land of the petitioners as Do Fasla land instead of commercial land, liberty shall be available to the petitioners to approach the competent authority in accordance with law who shall look into the grievance of the petitioners and pass appropriate order within a maximum period of four months from the date of filing of objection by the petitioners along with a copy of this order.
