JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-04-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Rasulpur P.S. Case No. 133 of 2018 for the offence under Sections 399, 402, 120B of the Indian Penal Code and Sections 25(1-b) a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. In the instant case, it is alleged that one country made pistol and one live cartridge were recovered from the possession of the petitioner. The petitioner is in custody since 30.10.2018.

Considering the fact that the petitioner has got no criminal antecedent and he has remained in custody for more than five months, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees
