The petitioners are apprehending arrest in connection with Jhajha P.S. Case No. 188 of 2016 for the offence under section 302/34 of the Indian Penal Code.
It appears from the police report submitted on 3.11.2016 that after investigation police found the case true against Sapna Kumari and submitted final report against the petitioners and others. The learned CJM differing with the police report took cognizance under section 302 and 304 of the Indian Penal Code. Although, the police has submitted final form against the petitioners and other.
Patna High Court Cr.Misc. No.31463 of 2017 (2) dt.13-07-2017 2/2 Submission of the petitioner is that the deceased has committed suicide. In any view of the matter after investigation the police have submitted final report against the petitioners and as such petitioners deserve anticipatory bail.
Considering the fact that the police after investigation submitted final report against the petitioners and also the fact in paragrapth-3 there is statement on behalf of the petitioners on affidavit that the petitioners have no criminal antecedent, let the petitioners, named above, be released on bail in the event of surrender or arrest before the court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Jamui, in connection with Jhajha P.S. Case No. 188 of 2016, subject to the condition as laid down under section 438(2) of the Cr.P.C.
