JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2019 Petitioner is permitted to make necessary correction in prayer portion of the bail petition in course of the day. Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 363/365/302/201/120-B of the Indian Penal Code.

Petitioner is not named in the first information report. However, in course of investigation, it came to light that one Murshid Ansari had talked to deceased through his mobile phone and, subsequently, it also came to light that this petitioner had talked with Murshid Ansari through his mobile and on the basis of aforesaid revelation, the petitioner was arrested and confessed his guilt disclosing this fact that he along with others committed the murder of the

Submission on behalf of the petitioner is that except suspicion and so-called confessional statement, there is nothing against the petitioner, who is in jail custody since 21.8.2018 and investigation against him has already completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge IV, Jamui/concerned Court in connection with Sono P.S. Case No. 225/2018 (Sessions Trial No. 29/19).
