Initially, case was registered under section 365/34 of the IPC against unknown persons. Subsequently, section 302 of the IPC was added. The name of the petitioner surfaced in this case in course of investigation and it was found that he had kept vigil over the activity of the police and except the aforesaid material, there appears to be nothing against the petitioner.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in Rajgir P.S. Case no. 289/2018. (Hemant Kumar Srivastava, J) s.hassan/- U T
