JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 11-08-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor representing the State of Bihar. This application, for grant of anticipatory bail, arises out of Punpun Police Station Case No. 103 of 2016, disclosing offence under Sections 498A/304B/201/34 of the Indian Penal Code.

The petitioner no. 1 is the sister of the husband of the deceased; whereas petitioner no. 2 is the husband of petitioner no. 1.

Learned Counsel appearing on behalf of the petitioners has submitted that they were living separately and have no concern with the family of the brother of petitioner no.

Patna High Court Cr.Misc. No.29739 of 2017(3) dt.11-08-2017 2/2 1, husband of the deceased. It has also been submitted that there is nothing specific against the petitioners in the First Information Report.

Considering the above submissions, this application is allowed.

Let the petitioners, namely, Munni Devi and Jai Prakash Rai, in the event of their arrest or surrender before the Court below within a period of six weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Masaurhi, Patna, in connection with Punpun Police Station Case No. 103 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure, 1973. This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court below on two consecutive occasions, their bail bond shall be liable to be cancelled.
