JUSTICE SANJAY PRIYA ORAL ORDER 3/ 21-09-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends his arrest in Kodha P.S. Case No.286 of 2016 instituted for the offence under Section(s) 341, 323, 307, 302/34 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Kaithar.

There is specific allegation in the written report that this petitioner caught hold the hand of son of the informant and co-accused, Jyotish Rabidas, gave knife blow in his stomach and thereafter they fled away.

Case diary has been received, wherein, witnesses have supported the case. Post mortem report has been mentioned in para 42 of the case diary, wherein, the doctor has found lacerated wound in the abdomen from penetrating weapon.

Patna High Court Cr.Misc. No.29747 of 2017 (3) dt.21-09-2017 2/2 In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.

Prayer of the petitioner for grant of anticipatory bail is rejected.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law on its own merit without being prejudiced by this order.
