JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Special Case No. 10503 of 2018, arising out of Digha P.S. Case No. 559 of 2018 for the offence under Sections 30(a) and 37(b)(c) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 02.11.2018. He further submits that so far as this petitioner is concerned, 15 litres of country made liquor was recovered .

Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each
