02. In the present case, the petitioner seeks bail in connection with Cyber P.S. Case No. 2300 of 2024, registered on 06.12.2024, for the alleged offences under Sections 318(4), 319(20, 336(3), 112(2) and 61(2)(b) of Bharatiya Nyaya Sanhita, 2023 and Sections 66(C) and 66(D) of the I.T. Act.

03. As per prosecution case, petitioner was apprehended for being involved in cyber fraud by alluring innocent persons for arranging loan for them and withdrawing money from their accounts.

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case merely on suspicion. There is no material to connect the

Patna High Court CR. MISC. No.24727 of 2025(2) dt.30-04-2025 2/3 petitioner with the offence as alleged. There is no complaint against the petitioner that he cheated any person of any money. Learned counsel further submits that even from the FIR, it is apparent that petitioner and co-accused person were apprehended merely on suspicion and except for mobile phone, no incriminating article has been recovered from them. The petitioner is having antecedent of two cases of Excise Act and he is on bail in both the cases. The petitioner is in custody since 08.12.2024 and charge-sheet has been submitted.

05. Learned APP for the State opposes the prayer for bail. Learned APP submits that the petitioner and co-accused Anant Kumar are kingpin who have been running a gang of cyber criminal.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Patna in connection with Cyber P.S. Case No. 2300 of 2024, subject to the conditions mentioned in Section 480(3) of BNSS and the

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
