2. Petitioner seeks regular bail in connection with Rajpur P.S. Case No. 224/ 2024 dated 15.07.2024 registered for the offence(s) punishable under Section(s) 25(1B)a, 26 and 35 of the Arms Act.
3. The main submissions advanced by the petitioner's counsel are that the instant matter relates to the recovery of firearms and as per the allegation, five accused persons, including the petitioner, were seen riding on two motorcycles speedily and the police party stopped them and on search, from the petitioner's possession, one loaded country made pistol and five live cartridges were allegedly recovered, in fact, the

No.25403 of 2025(2) dt.06-05-2025 2/3 petitioner was falsely roped in the alleged recovery and the police party did not follow the provisions of search mentioned in sections 50, 100, 103 and 165 of the Cr.P.C., though, against the petitioner there is one another case bearing Rajpur P.S. Case No. 223 of 2024 which was lodged on the same date relating to the offence of dacoity and three accused persons, who are allegedly apprehended with the petitioner, namely, Ritesh Kumar @ Ritesh Kumar Yadav, Alok Kumar @ Pritam and Dadan Chaudhary have already been granted bail by the coordinate bench of this court vide orders passed in Cr. Misc. Nos. 68333 of 2024, 84493 of 2024 and in Cr. Misc. No. 1317 of 2025 respectively. It is lastly submitted that petitioner has been languishing in jail since 16.07.2024 and investigation against him has been completed and the alleged offences of the present matter are triable by the court of Judicial Magistrate 1st class.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.
5. Considering the facts and circumstances of the case as well as the aforesaid submissions advanced by the petitioner's counsel and mainly the custody period of the petitioner as well as completion of investigation against him, this court is inclined to grant the relief of regular bail to the
Patna High Court CR. MISC. No.25403 of 2025(2) dt.06-05-2025 3/3 petitioner. Accordingly, let the petitioner named-above be released on bail in connection with Rajpur P.S. Case No. 224/ 2024 on furnishing bail bond of Rs.20,000/-( Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned with the condition that petitioner shall be released after framing of charge, if the same has not been framed.
