JUSTICE RAKESH KUMAR ORAL ORDER 08-09-2016 Heard Sri Anirudh Kumar Singh, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner , who is none else but the husband of the deceased, apprehending his arrest in Akorhigola P.S. Case No. 45 of 2016 registered for the offence under section 304(B) / 34 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest or surrender.

It was submitted by learned counsel for the petitioner that at the time of occurrence the petitioner was not present. He further submits that though marriage was allegedly solemnized in the year 2015 till the date of occurrence in the present case earlier there was no complaint about either torture or demand of dowry. On aforesaid grounds a prayer has also been made for

Patna High Court Cr.Misc. No.34571 of 2016 (2) dt.08-09-2016 2/2 allowing the present petition.

Keeping in view the nature of accusation and the fact that petitioner was husband of the deceased , I am not inclined to extend the privilege of anticipatory bail.

The petition stands dismissed.
