The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 188, 294 and 506 of the Indian Penal Code read with Sections 27 of the Arms Act along with 25(9) of the Amended Arms Act. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that the petitioner fired twice in air in a dance programme which was inaugurated by the Mukhiya. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that from perusal of the allegations as alleged in the FIR it would manifest that no one was injured in the alleged

Patna High Court CR. MISC. No.24528 of 2023(2) dt.18-07-2023 2/2 firing and the Chowkidar, who is the informant, alleges that petitioner fired twice in air in a dance programme. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Janki Nagar P.S. Case No. 285 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. with a further condition that one of the bailors of the petitioner shall be his elder brother, Dhirendra Kumar @ Darinder Kumar.
