JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2017 This application has been filed for modification of order dated 1.3.2017 passed in Cr. Misc. No.8777 of 2017, by which the petitioner has been directed to surrender within a period of four weeks and on surrender, the learned court below shall release the petitioner on bail, however, it is submitted on behalf of the petitioner that the petitioner could not surrender as she was not well and she was at Bombay. Now the petitioner has filed an application for modification of order dated 1.3.2017 passed in Cr. Misc. No.8777 of 2017, Heard learned A.P.P.

Having heard both such, such type of order is not passed by this Court, as such, I am not inclined to modify the order, however if the petitioner surrenders within a period of two weeks, the learned court below will consider that due to medical reasons, she could not appear and considering all aspects of the

Patna High Court Cr.Misc. No.32108 of 2017 (2) dt.12-07-2017 2/2 matter favourably he will pass positive order without being prejudiced by the order of this Court.

With the aforesaid observation, this application is disposed of.
