JUSTICE SUDHIR SINGH ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Barh P.S. Case No.378 of 2015 for the offences instituted under Sections 354(D), 326, 420, 506 and 120(B)/34 of the Indian Penal Code.

The prosecution case, in brief, is that complainant informant was doing job in IIFL at Patna but due to ill health and torture by the accused persons left the job. The petitioner is son of informant's mother's sister (Mausera Bhai). The petitioner due to relative visiting the ouse of informant and took her photograph in his mobile, prepared photo by electronics and started to pressurize the informant for marriage otherwise you may not be able to live

It is submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. Petitioner has falsely been implicated in the present case. There is no substantive evidence to show involvement in the alleged crime. It is further submitted on behalf of the petitioner that the petitioner is ready to deposit an amount of Rs.25,000/- in the court below which shall be subject to the final disposal of the case. It is further undertaken by the petitioner that in future he shall not be interfering in the private life of the informant.

On behalf of the State and the counsel for the informant, it is submitted that if the petitioner do not interfere in the personal life of the informant that would serve the purpose. Considering the aforesaid facts and circumstances, it is directed that the petitioner was not interfered in the personal life of the informant and shall deposit an amount of Rs.25,000/- in the court below which shall be subject to the final disposal of the case. Let the above named petitioner, in the event of arrest or surrender in the court below within a period of eight weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Barh, Dist.
