The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 147/149/341/342/323/406/420/506 of the Indian Penal Code. After hearing learned counsel for the petitioner and learned counsel appearing on behalf of the informant, it appears that the dispute is regarding two bags of rice and non return of the money for not having delivered the aforesaid rice. It appears from the submissions and the First Information Report that the victim has suffered a cut injury on his head. However, considering the fact that there was no pre-meditation and that the occurrence took place on the spur of the moment on account of the fact that the victim had refused the money which had been advanced to him and that the petitioner has got no criminal antecedent, let the

No.30365 of 2016 (2) dt.16-09-2016 P2/2 petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Purnea in connection with Sadar P.S. Case No. 180 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
