JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406 and 409 of the Indian Penal Code.

The prosecution case is that for the construction of grains godown in Mahamada PACS Rs.12,20,000/- was allotted. The Chairman of the PACS and the petitioner entered into an agreement for construction of the same and the petitioner was given Rs.3,21,000 but the construction work was not started. It is submitted by the learned counsel for the petitioner that the petitioner has already deposited with the authority the entire amount of Rs.3,21000/-.

Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for three

Patna High Court Cr.Misc. No.41093 of 2015 (2) dt.07-10-2015 2/2 months in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra in connection with Garkha P.S. Case No.147 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. The provision bail of the petitioner will be confirmed by the learned court below after getting it verified that the entire amount given to the petitioner has already been returned.
