JUSTICE BIRENDRA KUMAR ORAL ORDER 14-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Vaishali (Belsor O.P.) Case No. 106 of 2017 for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.

Allegation against the petitioner and other co-accused is of commission of kidnapping of Rani Kumari aged about 14 years.

Submission of the learned counsel for the petitioner is that there is love affair between Rani Kumari and one of the coaccused named Saroj Kumar and both have solemnized the marriage. In her statement under Section 164 of the Cr.P.C.,

Patna High Court Cr.Misc. No.31359 of 2017 (2) dt.14-07-2017 2/2 though, Rani has alleged kidnapping. However, alleged nothing more against the petitioner.

Let, the petitioner, above named, in the event of his arrest or surrender the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court below/Successor Court in connection with Vaishali (Belsor O.P.) Case No. 106 of 2017 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
